| This Privacy Policy explains how Undiscovered America LLC collects, uses, discloses, and protects personal information when you use undiscoveredamerica.org and related services. |
1. Scope and Who We Are
Undiscovered America LLC, a Utah limited liability company (“Undiscovered America,” “we,” “us,” or “our”), operates undiscoveredamerica.org and any page, store, form, newsletter, or digital service that links to this Privacy Policy (collectively, the “Site”). This Policy applies to personal information we process through the Site and related communications. It does not apply to a third party’s own website, platform, payment service, or privacy practices.
By using the Site, you acknowledge the practices described in this Policy. Where consent is legally required, we will request it separately. This Policy should be read with our Terms and Conditions.
2. Personal Information We Collect
Information you provide
Contact information, such as your name, email address, telephone number, mailing address, and the contents of messages you send us.
Order and transaction information, such as products purchased, billing and shipping details, order history, discount use, and transaction identifiers. Payment-card or bank information is generally collected and processed directly by the payment provider rather than stored by us.
Account information, if accounts are offered, such as username, password or authentication information, preferences, and account activity.
Newsletter, marketing, survey, contest, or promotion information, including communication preferences and responses.
User content, such as comments, reviews, photographs, stories, or other material you choose to submit. Information posted publicly may be viewed, copied, or used by others.
Any other information you voluntarily provide.
Information collected automatically
Device and technical information, such as IP address, browser type, operating system, device identifiers, language, and approximate location derived from IP address.
Usage information, such as pages viewed, links clicked, referring pages, dates and times of visits, session duration, searches, interactions with content, and errors.
Cookie and similar-technology information, including identifiers used to remember settings, maintain security, understand traffic, and measure content or campaigns.
Information from other sources
Payment, fulfillment, email, analytics, hosting, anti-spam, social-media, and other service providers may provide transaction status, fraud signals, delivery status, campaign performance, or account information.
Social networks or third-party platforms may provide information when you interact with our pages, embedded media, or links, according to your settings and their policies.
We may receive publicly available information or information from collaborators and business partners where permitted by law.
3. How We Use Personal Information
Operate, maintain, secure, troubleshoot, and improve the Site.
Provide requested content, respond to messages, manage accounts, and provide customer support.
Process and fulfill purchases, payments, shipping, returns, refunds, and related communications.
Send newsletters, promotions, or other marketing where permitted, and honor opt-out choices.
Understand Site use, measure audiences and campaigns, and develop content, products, and features.
Moderate comments and user submissions; detect spam, fraud, abuse, security threats, and violations of our Terms.
Comply with law, enforce agreements, establish or defend legal claims, and protect the rights, safety, and property of users, the public, and the Company.
Create aggregated or deidentified information that does not reasonably identify an individual.
Where applicable law requires a legal basis, we process information as needed to perform a contract, pursue legitimate business interests, comply with legal obligations, protect vital interests, or with consent. You may withdraw consent for future processing where consent is the basis, without affecting earlier lawful processing.
4. Cookies and Similar Technologies
The Site and its service providers may use cookies, pixels, local storage, scripts, and similar technologies. These may be used for essential operation and security; remembering preferences; analytics and performance; embedded content; and, if enabled, advertising or campaign measurement.
You can control many cookies through your browser and any cookie-preference tool displayed on the Site. Blocking cookies may cause some features to work incorrectly. Cookie choices are generally browser- and device-specific. Some browsers transmit Do Not Track signals, but no uniform response standard applies. Where required by applicable law, we will recognize a legally valid opt-out preference signal, such as Global Privacy Control, for the browser or device that sends it.
5. Analytics, Advertising, and Embedded Content
We may use analytics services to understand traffic and Site performance. These providers may collect device, cookie, and usage information under their own terms. If advertising, retargeting, or cross-site campaign measurement is enabled, advertising partners may use identifiers and browsing activity to select or measure ads. We will provide consent or opt-out controls where required by law.
The Site may embed or link to content from services such as YouTube, podcast players, social networks, maps, or other media platforms. When you load or interact with embedded content, the provider may collect information as if you visited its service directly, even if you do not have an account or are not signed in. Review that provider’s privacy policy and controls.
6. How We Disclose Personal Information
We may disclose personal information to the following recipients for the purposes described in this Policy:
Service providers that support hosting, website administration, data storage, security, analytics, email delivery, customer service, order fulfillment, shipping, accounting, and professional advice.
Payment providers. If you select PayPal or a related PayPal service, PayPal independently processes information needed for the transaction under its Privacy Statement at https://www.paypal.com/us/legalhub/paypal/privacy-full. Other payment providers are governed by their own privacy notices.
Business and content partners when needed to provide a requested feature, promotion, or collaboration, or with your direction or consent.
Government authorities, courts, law enforcement, regulators, and other parties when we reasonably believe disclosure is required by law or necessary to protect rights, safety, security, or property; investigate wrongdoing; or enforce agreements.
A buyer, investor, lender, adviser, or successor in connection with an actual or proposed merger, financing, reorganization, sale of assets, acquisition, bankruptcy, or similar transaction, subject to appropriate safeguards.
Other parties at your direction or with your consent.
We may disclose aggregated or deidentified information that cannot reasonably be used to identify you. We do not sell personal information for money. Certain analytics or advertising technologies, if enabled, may be considered a “sale,” “sharing,” or targeted advertising under some state privacy laws even when no money changes hands. Where those laws apply, we will provide the required opt-out method and honor applicable preference signals.
7. Your Choices

Cookies: use the Site’s cookie controls, if displayed, or your browser settings.

8. U.S. State Privacy Rights
Depending on where you live and whether a state privacy law applies to Undiscovered America, you may have rights to request access to or confirmation of personal information; correction; deletion; a portable copy; and information about categories of data, sources, purposes, and recipients. You may also have the right to opt out of certain sales, sharing, targeted advertising, or profiling; limit certain uses of sensitive personal information; appeal a denied request; and receive equal service without unlawful discrimination for exercising a right.
To submit a request, email [INSERT PRIVACY EMAIL] with the subject “Privacy Request” or write to the address in Section 16. Describe the right you wish to exercise and the state where you reside. We may take reasonable steps to verify your identity and authority before responding. An authorized agent may submit a request where permitted by law, but we may require proof of authorization and identity verification. If we deny an appealable request, our response will explain how to appeal.
These rights are subject to legal definitions, thresholds, exceptions, and verification requirements. We may retain information as permitted or required for transactions, security, fraud prevention, legal obligations, free-expression protections, internal uses reasonably aligned with expectations, or legal claims.
9. Data Retention
We retain personal information only as long as reasonably necessary for the purposes described in this Policy, including providing services, maintaining business and tax records, processing transactions, resolving disputes, enforcing agreements, preventing fraud, and complying with law. Retention depends on the type and sensitivity of the information, the relationship involved, legal requirements, and risk. When information is no longer needed, we will delete, deidentify, or securely dispose of it where reasonably practicable. Backup copies may remain for a limited period until overwritten.
10. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no website, transmission, payment method, or storage system is completely secure, and we cannot guarantee absolute security. You are responsible for using strong, unique credentials and protecting your devices and accounts. If you believe your interaction with us is no longer secure, contact us promptly.
11. Children’s Privacy
The Site is intended for a general audience and is not directed to children under 13. We do not knowingly collect personal information online from children under 13. If we learn that we collected such information without legally required parental consent, we will take reasonable steps to delete it. A parent or guardian who believes a child under 13 provided personal information should contact us using Section 16.
12. Third-Party Sites and Services
Links to third-party websites, stores, social networks, applications, and services are provided for convenience. We do not control their privacy or security practices. Information you provide directly to a third party is governed by that party’s privacy notice, not this Policy. Review those policies before providing information.
13. International Visitors
Undiscovered America is based in the United States. If you access the Site from another country, your information may be processed in the United States and other countries where service providers operate. Privacy laws and government-access rules may differ from those in your country. Where legally required, we will use appropriate transfer safeguards.
14. Changes to This Privacy Policy
We may update this Policy to reflect changes in our practices, technology, services, or legal obligations. We will post the revised Policy and update the “Last updated” date. If a change materially affects privacy rights, we will provide additional notice when required. Changes apply prospectively from their effective date.
15. Relationship to the Terms and Conditions
This Policy describes privacy practices and does not replace our Terms and Conditions. If a conflict concerns the collection, use, or disclosure of personal information, this Policy controls to the extent required by applicable privacy law.
